Welcome to our website. These Terms and Conditions govern your use of the website and the purchase of audio accompaniments provided by Individual Entrepreneur Stukalov Andrei Gennadyevich ("we", "us", or "our"). By accessing our site or making a purchase, you agree to be bound by these terms.
1. Services and Product Types
We offer three types of interactions on our platform:
- Direct Purchase (Buy Now): Ordering of audio tracks that are based on musical works in the public domain.
- Send Request: Inquiry forms for audio accompaniments of works that may be subject to third-party copyright. These are not sold directly. Each request is reviewed individually for educational, private use, or fair-use compliance.
- Individual Order: A custom service for recording specific audio accompaniments from sheet music provided by the Buyer.
2. Payment and Delivery
2.1. Payment Method: All transactions are securely processed in advance via the third-party payment gateway, Prodamus. Prices are subject to change, but changes will not affect orders that have already been paid.
2.2. Delivery for "Buy Now" Orders: Upon successful payment, the download link to the audio file on Google Drive will be sent to the Buyer's email address manually within 24 hours.
2.3. Delivery for Individual Orders: Terms, deadlines, and pricing for custom recordings are negotiated individually via email (andreystukalov@mail.ru) before any payment link is issued.
3. Refund and Cancellation Policy
3.1. Digital Products (Buy Now / Send Request): Due to the intangible nature of digital downloads, all sales of ready-made audio accompaniments are final. Once the Google Drive download link has been dispatched to your email, no refunds, cancellations, or exchanges will be issued.
3.2. Technical Issues: If a file is corrupted or technically defective, please contact us within 7 days of purchase at andreystukalov@mail.ru, and we will replace or repair the file.
3.3. Individual Orders: Custom recordings cannot be refunded once the recording process has begun. Cancellations are only accepted prior to the agreed start date of the work.
4. Intellectual Property and Usage Restrictions
4.1. All audio tracks produced by us remain our intellectual property or are used under fair-use/educational guidelines.
4.2. The Buyer is granted a non-exclusive, non-transferable, revocable license for personal, educational, and non-commercial professional use (e.g., private rehearsals, music lessons, non-monetized auditions).
4.3. Strictly Prohibited: Reselling, sub-licensing, public digital distribution, uploading to streaming platforms (including but not limited to YouTube, Spotify, Apple Music), or file-sharing of these tracks without our express written consent is strictly prohibited.
5. Limitation of Liability
We strive for the highest artistic and audio quality in our accompaniments. However, we are not liable for any discrepancies between our recordings and specific artistic interpretations, tempos, or performance expectations of the Buyer, unless specified in an Individual Order.
6. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Russian Federation. Any disputes arising out of or in connection with these terms shall be resolved through amicable negotiations. If a resolution cannot be reached, the dispute shall be submitted to the competent court at the Contractor's registration locality.
